This agreement is between you and L’ETOILE UNIVERSAL (referred to in this document as "us" or "we").

By visiting and/or using the L’ETOILE UNIVERSAL website (the "Website") you agree to be bound by the terms of this agreement ("agreement").

In order to purchase deals (and access any other features of the Website), you need to be a registered member by first creating a registered account on the web site ('Account').

When registering to become a member, you must provide Personal Information (as this term is defined in the Privacy Act 1988 (Cth)) including your first and last name, and a valid email address. You agree to provide accurate and complete information and to keep this information current. Your information is stored securely, and will only be used and disclosed in accordance with our Privacy Policy.

L’ETOILE UNIVERSAL reserve the right to close an existing Account that you have opened or attempted to open in an illegal manner or if you have breached the terms and conditions of this user agreement

You alone are solely responsible for your account activity and for keeping your Account login and Account password secure.
If you suspect or become aware of any unauthorised use of your account or that your password is no longer secure, you should notify us immediately. We are not liable for any unauthorised use of your account.

L’ETOILE UNIVERSAL Legal Capacity

In making an order to purchase any service or products you are entering into a fully and legally binding contract with L’ETOILE UNIVERSAL with respect to the purchase, and you are agreeing that L’ETOILE UNIVERSAL is not responsible for any faulty or damaged products and you are fully agreeing that what you are buying from L’ETOILE UNIVERSAL website, you take the warranty into consideration with the supplier for any warranty or repair that may occur with the terms and conditions of the purchases.

In Australia the Consumer Laws grant the consumers certain rights and protections related to the provision of goods and services that no one can exclude. Please note that there is nothing in these terms and conditions that can exclude or restrict the application of such a law. L’ETOILE UNIVERSAL does not give any guarantee or warranties or make any representation of any kind. Therefore with the respect to use this website subject to claims available under consumer protection laws, L’ETOILE UNIVERSAL, nor its related body corporate.

To you or anyone else (including for negligence, breach of contract or tort) L’ETOILE UNIVERSAL is not responsible for any loss or damage, loss of revenue, loss of opportunity, loss of anticipated savings, or any increased operating cost, caused and suffered directly or indirectly in connection with your use of this website.

L’ETOILE UNIVERSAL will have no responsibility of the goods repairing, replacing, or paying the cost of having goods purchased, or having those services resupplied. It will be your responsibility to have the services and goods replaced with the original supplier.

We put on note that you will at all times indemnify maintain indemnity towards L’ETOILE UNIVERSAL and their directors and employees, agents, and related body corporate (as that term is defined in the Corporations Act 2001) from and against any loss which includes reasonable legal costs and expenses on a full indemnity basis or liability suffered by you or by L’ETOILE UNIVERAL caused by any claim, demand, suit, action or proceeding by any person against you or L’ETOILE ELITE where such loss or liability arose out of, in connection with or in respect of your conduct or breach of any Voucher Specific Terms or other term or condition relating to a Voucher (as specified in these Terms & Conditions of Use) or a Merchants standard terms and conditions and policies.

Privacy

L’ETOILE UNIVERSAL privacy policy is incorporated into these Terms & Conditions of Use.

All information published on the L’ETOILE UNIVERSAL website about specific goods and services which the material is supplied to L’ETOILE UNIVERSAL by another third party and merchant, we will take all reasonable steps to make sure all this information is related to a merchant. If the third party provides L’ETOILE UNIVERSAL with accurate information consequently you will agree that L’ETOILE UNIVERSAL will not be held liable for a publication on the website of any inaccuracies or errors of information relating to goods and services it has received from Merchants and other third parties.

L’ETOILE UNIVERSAL provides it's customers and account-holders with the opportunity of purchasing vouches for goods and services at discounted, cheaper rates based on the terms and conditions of a third party merchant which can be redeemed for goods and services on each deal. By doing so you agree to receive and be charged for any voucher you purchase once L’ETOILE UNIVERSAL has received a minimum quantity of offers to purchase from our Account-holders during specified availability periods.

You also agree that you are responsible to make your own full enquiries to verify information published on our website related to goods and services, as well as assessing the suitability of goods and services prior to purchasing an order for a voucher of a deal relating to those goods or services.

By placing and purchasing an order for any Vouchers on the Website that means you are making a commitment to purchase the goods and services in a specific term on the conditions set out in this terms and conditions of use.

L’ETOILE UNIVERSAL reserves all rights to accept or reject your offer to purchase a Voucher for any or no reason. In case of this even L’ETOILE UNIVERSAL will charge-back the full purchase price to your nominated account.

Once you have made an order to purchase any goods or services advertised on our website you cannot cancel that sale or order.

Once you place your order of a voucher you will automatically receive confirmation of your order by email of via your nominated account, and you will be charged for the purchase of the voucher. Therefore you will be issued a voucher only if full payment has been received by L’ETOILE UNIVERSAL and the minimum amount sold has been met.

The voucher will be delivered to your via mail, by post, or can be downloaded and printed by your account. L’ETOILE UNIVERSAL is not responsible or reliable for any loss suffered as a result of your voucher not being received by you to and email or firewall or filter installed on your computer or you have registered an incorrect email address.

If you have placed an order and the Minimum Quota has not been met, you will not be entitled to any consideration, credit or full or partial refund, and L’ETOILE UNIVERSAL will charge-back the full purchase price to your nominated account.

Redemption of vouchers

When you redeem a voucher that L’ETOILE UNIVERSAL issued to you with the relevant merchant in order, the relevant merchant not L’ETOILE UNIVERSAL is the provider of the product and service and is solely responsible for honouring the deal that is subject to the voucher you have purchased and not L’ETOILE UNIVERSAL.

Terms of voucher

You agree when you purchase a Voucher from L’ETOILE UNIVERSAL it is subject to specific terms and conditions, and limitations and restrictions and other eligibility terms included to a Voucher, and fully respect and agree to the required time to make the booking with the merchant to redeem your voucher (always read the specific voucher terms) which will be displayed and noted on the website prior to your purchase of specific vouchers which will be issued to you. You also agree that all voucher specific terms will be legally binding on your in connection and conjunction with that Voucher.

All the terms apply to all vouchers without limiting the other terms and condition in the terms and conditions of use. You also agree that vouchers are not redeemable for cash, as well as you agree that if you cannot use or redeem a voucher you have purchased, you are not entitled to any consideration, be credited or refunded on the purchase price of the voucher. Please note that L’ETOILE UNIVERSAL is not responsible or reliable for lost or stolen vouchers.

The expiration date for the voucher is always as printed on the Voucher as well as always being quoted on the Website. Therefore all Vouchers are deemed void after the published expiration date and will not be honoured by L’ETOILE UNIVERSAL or the Merchant, and definitely non-refundable in whole or in part.

You must book before the specified date on the voucher which will be quoted on the L’ETOILE UNVIERSAL website, and please note that any voucher which requires a booking will be deemed void if a booking is not made before the specified ending date.

All vouchers cannot be sold, resold, or offered for resale, duplicated, used, traded or used for advertising, promotion or other commercial purposes, including competitions and trade promotions, or to promote demand for other goods or services.

Terms of deals in general

All advertised deals are strictly subject to the Merchants standard terms and conditions and policies. L’ETOILE UNIVERSAL take further steps of some the terms and conditions supplied to us by the merchant that will affect your ability to use the terms and conditions of the policy of the merchant. Therefore you fully agree to be responsible for making your own enquiries about the terms and conditions and policies of a specific Merchant.

Therefore all deals relating to provided services by merchants are all subject to availability and you are required to make a booking in advance only with the Merchant. That's why we cannot guarantee that services to be available to you at your preferred date or time.

You also agree that any booking you make with the Merchant may be subject to their separate terms and conditions and policies.

The merchant has got every right to charge you a cancellation fee if you cancel a service booked which may include invalidation or cancellation of your ability to redeem the relevant Voucher.

Terms and conditions of product deals

The product deals provided by Merchants may require you to pick up the relevant advertised products from the specific location or to pay the fee to have it product delivered to your nominated address.

Having said that, if the merchant and/or L’ETOILE UNIVERSAL includes the estimated timeframe for delivery in the voucher's terms and conditions advertised on the website, we will do everything in our power to make sure the merchant delivers the product to you within the timeframe estimated for delivery.

Limitation of Liability

The Consumer Laws in Australia grant you certain rights and protections related to the provision of services and goods that no one can exclude within these terms and conditions of use, or restrict the application of such laws but, to the extent that it can under these laws, L’ETOILE UNIVERSAL in no way will give any guarantee or warranties or make any representation of any kind, express or implied, in relation to the Vouchers, a Deal and/or the goods and services which are the subject of a Deal outside these consumer laws. Subject to claims available under consumer protection laws, L’ETOILE UNIVERSAL and its related bodies corporate (as that term is defined in the Corporations Act 2001) is not liable to you or anyone else (including for negligence, breach of contract or tort) of any damage or loss which includes any form of consequential loss such as any third party loss, loss of profits, loss of revenue and loss of opportunity, including the loss of anticipated savings and any increased operating cost however caused and which is suffered directly or indirectly in connection with a Voucher, a Deal and/or the goods and offers that are the subject of a Deal.

For any claims related to a Deal or the goods or vouchers that are the subject of a special Deal that cannot be excluded or restricted under consumer protection laws : 

  (a) you will be entitled for a full reimbursement for a voucher if there is a major failure by L’ETOILE UNVERSAL to comply with the consumer guarantees under the Australian consumer laws, and

  (b) If there is any minor failure by L’ETOILE UNIVERSAL to comply with the consumer guarantees under these laws, in the case of goods, repairing or replacing those goods, or paying the cost of having those goods resupplied by the merchants, L’ETOILE UNIVERSAL will take any step possible to make sure the merchant will resupply or fix the issue and it is for you to follow up with the merchant.

L’ETOILE UNIVERSAL satisfaction guarantee terms and conditions

  1 - L’ETOILE UNIVERSAL account holders may be entitled to receive full cash refund or credit if L’ETOILE UNIVERSAL have mentioned on the voucher, goods and services, the condition for refund. If you are not satisfied with the quality of the goods and services received from the voucher, you will have to follow up with the merchants in that regard. L’ETOILE UNIVERSAL is not liable for refund or exchange.

  2 - L’ETOILE UNIVERSAL is not liable to provide refund in the circumstances where a Merchant ceases to trade and enters bankruptcy or liquidation (as relevant).

  3 - Where a booking is required to redeem a Voucher, L’ETOILE UNIVERSAL member must have made, or attempted to make a booking prior to the relevant date explained on the individual voucher or deal.

  4 - L’ETOILE UNIVERSAL account holders in the circumstances of requesting a refund will be asked to provide a full account of their experience with the goods and service, and full particulars as to why they're not satisfied with the quality of the goods and the services subject to the sale of the voucher, as well as why they are not satisfied with the quality of the goods and services that are the provided by the Merchant which is in the terms and conditions for that Deal as published on the Voucher and/or the Website.

  5 - L’ETOILE UNIVERSAL will consult on your behalf with the relevant merchant responsible for fulfilment on the deal

  6 - Where L’ETOILE UNIVERSAL concludes that a complaint is invalid or that an account holders details are misleading, incorrect and/or deceptive: L’ETOILE UNIVERSAL reserves the right to refuse a Refund (in its sole discretion).

   Where an Account-holder has previously received a Refund from L’ETOILE UNIVERSAL we reserve the right to refuse a further request for a Refund made by that Account-holder (in its sole discretion).

  7 - Also L’ETOILE UNIVERSAL will reserve the right to refuse a refund for the account holder if their voucher with the merchant prior to the must book before date as printed on the voucher, L’ETOILE UNIVERSAL account holders should make sure they are aware of the Must Book Before date. Therefore L’ETOILE UNIVERSAL will refuse and reserves the right to refuse the refund in its sole discretion.

  8 - L’ETOILE UNIVERSAL reserves the right to resolve an Account-holders complaint and/or dissatisfaction with the goods and/or services provided by a Merchant via other means prior to paying any Refund to that Account-holder.

  9 - L’ETOILE UNIVERSAL’s Satisfaction Guarantee policy may be amended or cancelled at L’ETOILE UNIVERSAL’s sole discretion, and will take no liability or responsibility of a refund or replacement of any goods or services, and you should be wholly responsible to take this matter further with the merchant.
